by the Public Prosecutor
On
04/01/05, Enrique Molina made his request for
Case 18/01, asking for 654 years in jail for the
42 accused, against whom he issued charges of
“cooperation” with or “membership”
of ETA, due to their alleged role as “leaders”
of Jarrai, Haika or Segi. According to the public
prosecution, these youth organisations are part
of ETA’s “mass-movement front”,
and they have “identical objectives to ETA,
they are hierarchically submitted to ETA and they
are financially united”. The public prosecution
requested 10 years in jail for ten of the youths,
and 14 years for another thirty one. The prosecutor
also requested 111 years and 10 months in jail
for Asier Tapia, due to his appearance at a massive
press conference on the day after the arrest of
fifteen young Basques and the searching of four
Haika offices. Tapia read a press statement denouncing
the police operation and generically calling on
Basque young people to respond to the assault
on their organisation. The prosecutor has decided
to charge Tapia with all the violent protest that
took place in subsequent days. The prosecutor
also asked the court to order that “Herri
Batasuna-Euskal Herritarrok-Batasuna to pay the
damages”.
The
private prosecution, carried out by the Association
of Victims of Terrorism (AVT) supported the public
prosecutor’s request and increased the length
of prison sentences by 336 years in total, as
a consequence of adding 8 years more for each
of the accused for a crime of “genocide”.
As they say in their own web-page, “this
penal figure has never been applied in our courts”,
while they argue that Jarrai-Haika-Segi allegedly
“intended to partially or totally destroy
a national, ethnic, racial or religious community.
They have tried to harass and expel all those
who did not follow nationalist-terrorist dictates
from the Basque Country”.
